Once the order form, terms of use agreement, and payment have been received by us, the plans and other included resources for the design you have selected will be sent to you within 14 days, via Fed-X Express Saver.
For "Rush" orders (receive within 5 days) add $49 to purchase price).

Terms of Use Agreement

Please read this entire agreement thoroughly!

E & C Consulting does hereby grant the purchaser of "Coffee Drive Thru Plans" (the "Plans"), a limited nonexclusive license to use the Plans for the construction of up to 3 buildings on the following terms and conditions:

1. USE OF PLANS:
Purchaser understands that this is a license to use the Plans for the construction of up to 3 buildings. All rights in the Plans are owned by E & C Consulting, Inc., an Oregon corporation. Rights to the use of the Plans may not be assigned or transferred by the purchaser.  

Purchasers may acquire a license to construct additional units by paying an additional fee of $1,500 per unit, on every drive thru building constructed after the first three. Additional fees should be paid to E & C Consulting, Inc., prior to beginning construction on any additional drive thru structures. Payment may be made by credit card by calling E & C Consulting offices at (1-541) 317-0555, or by check or money order sent to:

The Plans will not be licensed to and are not to be purchased, or used, by companies or individuals involved in the manufacturing and/or sale of espresso/coffee drive thru structures, without the prior express written consent of Ed Arvidson, President, E & C Consulting, Inc.

2. DUPLICATION AND/OR REDISTRIBUTION OF PLANS:
Purchaser understands and agrees that the Plans may not be copied, scanned, traced, redrawn (by hand or electronically), or duplicated in any way, nor may they be sold, sublicensed, published, or redistributed, in whole or in part, whether for profit or not, to anyone except as specifically provided herein.

The Plans are protected by the copyright laws. Rights of use are strictly limited to the purchaser of the license to use the Plans. As licensee you may lend the Plans to bureaucracies and contractors directly involved in the construction of the drive thru structure, as needed. 

3. MANIPULATION OF PLANS FOR BUREAUCRATIC APPROVAL:
Because the Plans may require alterations to satisfy the specific requirements of some local bureaucracies, the services of an architect or architectural draftsman may be necessary. All expenses for alterations to the Plans by an architect, draftsman, or any other individual or company and, any problems or challenges which may occur as a result of design changes made by third parties, are the sole responsibility of the purchaser of the Plans. 

Electronic "Auto CAD" files (computer assisted design program), which can be used to make needed modifications, may be licensed from E & C Consulting, at no charge, by your architect or draftsman upon written request and their agreement to enter into and comply with a SEPARATE terms of use agreement. Only those drawings requiring modifications will be provided as electronic files. (Some drawings, primarily exterior elevations, foundation plans, and isometric renderings, may not be available in Auto CAD because they were not generated in that program).

4. LIMITED LIABILITY AND WARRANTY DISCLAIM:
While every effort has been made to design these drive thru buildings with substantial care, E & C Consulting accepts no responsibility for damages, injury, death, and/or the expenses and liability resulting therefrom, should the drive thru building suffer damage or structural failure, in part or totality.

Because of the variance in local building codes, requirements and practices, the differences in geography and climate and our lack of control over the actual construction, WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO THE CONTENT OR USE OF THE "COFFEE DRIVE THRU PLANS," INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE.


5. EXCHANGES, RETURNS, & REFUNDS:
All sales are considered final, and any refunds or exchanges are solely at the discretion of E & C Consulting.
